Data protection information
You have chosen to use the MAN Driver App. Thank you for placing your trust in us. In conjunction with the associated use of the app, we collect and process various items of personal data that are required in order to fulfil the stated purposes. In accordance with Article 13 of the EU's General Data Protection Regulation (GDPR), we provide you with the following information on the specific data involved, how this data is processed and what rights you have in this regard.

Purposes for which data is processed
The MAN Driver App is a mobile application that provides the user (driver) with various functions to support his activities before starting a journey and during journey interruptions (breaks, breakdowns, etc.) (e.g. vehicle check before departure, quick guide for MAN vehicles, Mobile24 breakdown call).

- When the user logs in, data is exchanged with TB Digital Services GmbH (RIO) if Perform, Timed, MAN ServiceCare or MAN SimplePay are booked on the RIO platform.
- In the event of a breakdown report, data is forwarded to MAN Service and Support GmbH (Mobile24).

Transmission of data to third parties
Your personal data will only be passed on to third parties if this is necessary in order for us to provide our services or if you have given your consent.

We have concluded appropriate data processing agreements for the cooperation with partners that is necessary for the provision of the app and the use of the functions.

Transfer to third countries
When using data for product analysis with Google Analytics, data is transferred to the USA.

Data retention period
Your personal data will be deleted when it is no longer required to fulfil the purpose for which it was stored, unless this conflicts with statutory retention requirements, or if its storage is inadmissible for other legal reasons.
Personal data will be automatically deleted after 12 months of inactivity (non-use of the Driver App or non-acceptance of a change to the General Terms and Conditions). -
You have the following rights:
- In accordance with Article 15 GDPR, you can obtain information from the data controller in relation to the personal data concerning you that is being processed (e.g. the purposes of the processing, the categories of personal data involved, the categories of recipient or the planned storage period).
- In accordance with Article 16 GDPR, you can demand immediate rectification of incorrect personal data or completion of personal data stored by the data controller.
- In accordance with Article 17 GDPR, you can, under certain circumstances, insist on the erasure of the personal data concerning you that is stored by the data controller.
- In accordance with Article 18 GDPR, you can, subject to certain conditions, restrict the processing of your personal data.
- In accordance with Article 20 GDPR, you can obtain your personal data, as made available to the data controller, in a structured, conventional and machine-readable format or demand that it be transferred to some other data controller.
- In accordance with Article 7 (3) GDPR, you can, at any time, withdraw the consent you have given to the data controller. If you do so, the data controller will no longer be able to continue processing your data solely on the basis of that consent.
- In accordance with Article 77 of the GDPR, you can lodge a complaint with a supervisory authority. Normally, this will mean approaching the supervisory authority for your usual place of residence or workplace or our company headquarters.

Information on mandatory data
Information marked as mandatory is either required by law or contract, or is necessary to enter into the contract.
Failure to provide mandatory information means that the purposes of the processing cannot be fulfilled.
Data that is not marked as mandatory information is provided on a voluntary basis. Failure to provide voluntary information will result in us not being able to provide you with adequate support or product recommendations. -

App access to device functions
The camera/photo function of the device is accessed to detect damage to the vehicle, recognise barcodes (VIN) and to detect switch symbols, etc. for the function of the quick guide.
Access to the telephone/text message function of the device takes place as part of Mobile24 contact establishment.
The device’s GPS function is accessed in order to establish the location when sending your location to- Mobile24 for use of the breakdown service
- Google for use of the ServiceFinder
- Here Maps for use of MAN Simple Pay
Access to the device’s Wi-Fi function takes place as part of data transmission (use of Wi-Fi if available).
The device’s memory is only accessed for the purposes of temporary storage of the recorded data. -
Data collection with registration as user
Within our app, we can provide functions that require you to register before you can use them. This involves us collecting your contact details where necessary. This personal data will only be passed onto third parties if this is necessary for the provision of the service, or if you have expressly agreed to this.

Data collection without registration as user
You can use our app without registering or providing personal information. In this case, alongside the location and device data required for use of the app functions, we will store only access data, such as the name of your Internet service provider, where applicable. The access data is data which is analysed in the form of usage profiles in order to improve the app. It does not provide any information about you personally.

Location (only via GPS)
In connection with the use of some features, we collect your current location via GPS in order to provide you with quick information about your immediate surroundings.
You can disable the transmission of your GPS position on most popular mobile devices (usually in the Settings menu). Please note that in this case not all features of our app will be available. -
Location (via GPS, GSM or Wi-Fi hotspots)
In connection with the use of some features, we collect your current location in order to provide you with quick information about your immediate surroundings.
You can disable the transmission of your GPS position and Wi-Fi hotspot registration on most popular mobile devices (usually in the Settings menu). Please note that in this case only the possibly inaccurate location via the mobile network (GSM location) will be possible and not all features of our app may be available. -
Data security in the app
We take technical and organisational security precautions in order to protect your personal data against accidental or premeditated tampering, loss, destruction or access by unauthorised persons. Our data processing and security precautions are constantly improved in accordance with technological developments.
All data transfers – between the app and our backend as well as to external interfaces – are encrypted (TLS 1.2). -
Changes in our data protection provisions
We reserve the right to change our data protection and security measures if this should become necessary due to technical developments. In such cases, we will amend our data protection provisions accordingly and notify you by appropriate means and – if required – obtain your consent for this.

App access to device functions

Web analysis
In order to constantly improve the user-friendliness and quality of the services that we offer and to adapt them to your needs, we use Google Analytics to analyse the use of our app. Google Analytics permits the evaluation of pseudonymised user behaviour (how often is a feature used, how much time is spent on it). In addition, we collect hardware and system data in order to be able to analyse possible faults in the app and, for example, to draw possible conclusions about the impact of the use of the app on driving behaviour.

You have the opportunity to participate in product satisfaction surveys. The survey is anonymous and voluntary.
